- DNA Test - Paternity
Can a paternity DNA test be performed when the father has already died?
Yes, it is possible to perform a DNA test when the father is deceased.
For cases where the possible father is deceased, there are several options available to help verify paternity. For the following relationship tests, involving the child's mother increases the accuracy of the results.
Grandparentage Test: When the father is deceased, this DNA test can determine the statistical probability of whether the possible grandmother and/or grandfather are biologically related to the tested children.
Sibling test: This DNA test determines if two people share one or both parents. Although it is an indirect way to prove or disprove paternity, it is an option when the father is deceased. This test can also be used for half siblings. The mother must give permission for siblings or half-siblings under the age of 16 to participate.
Avuncular test: DNA test of uncles or aunts, this is another option when the father is deceased, because uncles and aunts share 25% of their DNA with their nieces and nephews.
If you wish to perform a paternity test without the father, it is important to remember that written authorization is required from all adults whose DNA samples are provided for testing.
It is illegal to obtain a DNA sample from an alleged father for testing without his knowledge. Failure to obtain or misuse consent could result in penalties of up to three years in prison, a fine, or both.
